[Video] Hunger Strike To Avoid Foreclosure??
Here is a video from MSNBC, after you watch the video, see my comments below for some Insider Loan Modification Tips.
Please note that I post these videos to make homeowners aware of what's going on and not to discourage or depress anyone, I am not endorsing hunger strikes, instead I want to use these videos to educate homeowners and to offer tips that may apply to your situation if you are facing foreclosure or in need of a loan modification.
The first thing I want to point out is when it comes to foreclosure TIME is your enemy, so once you get any type of legal documentation from your lender or the courts you should get an attorney. Don't wait until you get an auction date. If you go to a foreclosure attorney when you get the notice of default or lis pendens which is the first legal document you will get in most states, you should hire an attorney to represent you, as they will be able to protect your rights and drag out the foreclosure process as long as legally possible, which in some states can be anywhere from 1-2 years.

The other thing I want to point out is that when Ms. Rymer went to a housing counselor, they told her she didn't qualify because her loan was not backed by Fannie Mae or Freddie Mac. I am not sure if the housing counselor gave her some options at this point but at a minimum I hope the counselor told her that her lender has other traditional or conventional loan modification programs that don't require her loan to be backed by any of the government agencies such as Fannie Mae. I just wanted to mention that to homeowners in the event this is a reason for denial either from a housing counselor or your lender.
You would think the lender or the housing counselor will provide this information, but the reality is sometimes they do and sometimes they don't. This is why I stress the importance of getting educated. It's your responsibility to be "in the know."

[Video] Frustrated Homeowners Take On Mortgage Lenders
This is a video clip from the Dylan Ratigan Show on MSNBC.
This video shows the unwillingness of the government to attack the foreclosure crisis the U.S. is experiencing. The federal loan modification program, more popularly known as the "Making Home Affordable Plan" maybe causing some homeowners to lose their homes, even though some of them were on-time with their mortgage payments before the modification.
The MHA program was designed to help both the bank and the homeowner. It would help the bank by giving them bailout money if they enrolled homeowners into this program and this plan would help keep homeowners in their home.
The problem or should I say the "CATCH" is that this government program is not mandatory for lenders, however in order for them to get the bailout money all the lender has to do is enroll the homeowner into a trial period. That means that the Big Dumb Greedy Banks were "working the system" by enrolling a lot of homeowners into the trial period to get the bailout money and then they denied them after the trial period is over.

Am I surprised the homeowner got denied? NO!
If this homeowner wanted to hire me to do a loan modification for him, I would have turned him down, as within minutes and without looking at his documents I could have determined he doesn't qualify, just by asking a few basic questions.
This particular homeowner fell victim of his Big Dumb Greedy Bank. First of all, the lender should have never sent him an offer to modify his loan, because he was on time with his payments and he wasn't experiencing any type of hardships.
This is why it's very important to get educated on the loan modification process, I talk about how to know if you qualify for a loan modification in my new book, you can get a copy here:

In my book I tell readers that at a minimum to qualify you must be experiencing a legitimate hardship such as job loss, divorce, death in the family etc.
I also talk about in the book that you don't have to be late to get a loan modification, however you must be in eminent danger of being late.
What does that mean?
It means you expect that in the near future you won't be able to make your payments because your interest rate will adjust soon, or you job will terminate soon etc.
So why did this homeowner get a solicitation from his lender for a loan modification?
His lender basically did a blanket mailing to homeowners that were in a specific zip code, without pre-qualifying the list of homeowners that they were mailing to. Or maybe it was just a ploy for the lender to get some bailout money, in which they completely disregarded how there actions could impact the homeowner.
This homeowner fell for the ploy, because he had a 7 % interest rate and the solicitation was offering as low as 3%. Now he was denied, credit tarnished and facing foreclosure.
Although a lot of homeowners are suing lenders, its important to know that these types of cases are in the infancy stages....... so is it really worth your time and money?
Well it depends, it's definately going to be a long drawn out process and it can be very costly with attorney fees and court cost.
Who should get educated about loan modification?
Any homeowner that has a mortgage, whether you're in the market for a loan modification or not. I encourage all homeowners to get educated.
